Terms of Service

These Terms of Service ("Terms") govern your access to yabelsoftware.com (the "Site") operated by Yabel Software ("we", "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who we are
Yabel Software is a fully remote digital agency providing software and mobile app development services. Client work is governed by a separate written agreement (proposal, SOW, or contract). If there is a conflict between these Terms and a signed client agreement, the client agreement controls for that engagement.
2. Website use
- You may browse the Site for lawful, informational purposes.
- You must not attempt to disrupt, scrape abusively, reverse engineer, or misuse the Site.
- Content on the Site (copy, branding, design) is owned by us or our licensors and may not be copied for commercial use without permission.
3. Inquiries and leads
Submitting a contact form or email does not create a client relationship. We may decline projects. Any quotes or timelines on the Site are illustrative starting points, not binding offers.
4. Services
Deliverables, fees, payment schedule, IP ownership, warranties, and liability for paid work are defined in the applicable client contract. Packages listed on the Site (including starting prices) are subject to change and scoping.
5. No warranties (Site)
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant uninterrupted or error-free access.
6. Limitation of liability
To the fullest extent permitted by applicable law (including EU and US consumer and commercial rules where they apply), we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or business, arising from use of the Site. Our aggregate liability relating to the Site shall not exceed USD 100. Nothing in these Terms excludes liability that cannot be excluded under mandatory law (e.g. death or personal injury caused by negligence, or fraud).
7. Indemnity
You agree to indemnify and hold us harmless from claims arising from your misuse of the Site or violation of these Terms, to the extent permitted by law.
8. Privacy
Personal data is handled as described in our Privacy Policy and Cookie Policy.
9. Third-party links
The Site may link to third-party sites (App Store listings, social networks). We are not responsible for their content or practices.
10. Governing law
These Terms are governed by the laws applicable to Yabel Software’s place of establishment and the mandatory consumer protection rules of your country of residence where they cannot be waived. Disputes will first be addressed in good faith; unresolved disputes may be brought before competent courts as required by law. For US users, you may also have rights under applicable state law.
11. Changes
We may update these Terms. The effective date will be revised accordingly. Continued use of the Site after changes constitutes acceptance where permitted.
